Terms of Service Agreement

Moretti Test Prep & Tutoring · morettitutoring.com

Effective September 16, 2026

1. Agreement to Terms

These Terms of Service ("Terms") govern your use of morettitutoring.com (the "Site") and any tutoring, test-preparation, or related services ("Services") provided by Moretti Test Prep & Tutoring ("Moretti Tutoring," "we," "us," or "our"), operated by Luca Moretti. By booking a session, enrolling a student, or otherwise using the Services, you ("Client," "you," or "your") agree to these Terms. If you are enrolling a student under 18, you represent that you are that student's parent or legal guardian and are agreeing to these Terms on their behalf.

2. Description of Services

Moretti Tutoring provides one-on-one academic tutoring and test-preparation instruction, including but not limited to math tutoring, SAT preparation, college essay coaching, and AP/IB support, delivered in person or online. Services are billed by the hour, either per session or from a prepaid session pack. Session format, length, frequency, and the recommended number of hours are agreed upon in writing with the Client before services begin. Sessions are typically sixty (60) minutes unless another length is agreed.

3. Scheduling, Rescheduling & Cancellation

  • Sessions are scheduled at a consistent, agreed-upon weekly time unless otherwise arranged.
  • If a student needs to miss a session, the Client must notify Moretti Tutoring in advance. We will make reasonable efforts to reschedule within the same week.
  • Cancellations with less than 24 hours' notice may be charged as a completed session (or drawn from a session pack), at Moretti Tutoring's discretion.
  • Moretti Tutoring reserves the right to reschedule a session in the event of illness, emergency, or unforeseen circumstances, and will provide as much notice as reasonably possible.
  • In-person sessions are held at the Cranford Public Library or another public setting agreed with the Client. Where an in-home session is separately agreed in writing, it must take place in a common area of the home (not the student's bedroom), with a parent or legal guardian present in the home for the duration of the session.
  • This in-home supervision requirement may be waived only with the Client's prior written consent authorizing Moretti Tutoring to conduct sessions without another adult present.
  • In-person sessions held in a public setting (such as a library or café) do not require a parent or guardian to be present.

4. Payment Terms

Rates are provided to each Client in writing before services begin and may vary by subject, session length, and format (in-person or online). Payment is accepted by invoice or through peer-to-peer payment applications (such as Venmo, Zelle, or PayPal) unless otherwise agreed in writing. Moretti Tutoring provides a written receipt for every payment.

Session Packs. A session pack is a prepaid block of tutoring hours (for example, ten hours). Each session draws down the pack by its actual length: a 60-minute session uses one hour, and a 90-minute session uses one and a half. Payment for a pack is due in full before the first session it covers.

Pack Expiration. A session pack expires six (6) months after the date of purchase. Any pause requested by Moretti Tutoring extends the expiration by the length of that pause. Hours still unused at expiration are forfeited unless Moretti Tutoring agrees in writing to extend them.

Single Sessions. Payment for a single session is due either no later than 24 hours before the scheduled session or immediately following it, whichever Moretti Tutoring specifies at the time of booking.

Existing Rates. A Client who agreed to a rate in writing before September 16, 2026 keeps that rate through March 31, 2027. After that date the Client's rate becomes the standard rate then in effect, and Moretti Tutoring will give at least thirty (30) days' written notice of the change.

Late Payment. If payment is not received by the applicable due date above, a late fee, in the amount stated in the Client's written rate agreement, will be charged for each week the payment remains outstanding.

  • Moretti Tutoring reserves the right to suspend future sessions until the outstanding balance, including any accrued late fees, is paid in full.
  • Continued non-payment for two (2) weeks past the due date may result in termination of services for the remaining balance owed.

5. Refunds & Termination

Either party may end the tutoring relationship at any time, for any reason, by providing written notice (a text or email is sufficient) to the other.

If Moretti Tutoring ends the relationship for any reason other than non-payment under Section 4, the Client receives a full refund of all unused prepaid hours.

If the Client ends the relationship, the hours already used are charged at the single-session rate (any pack discount no longer applies to them), and the rest of the amount paid is refunded.

A refund must be requested before the pack expires, and is paid within fourteen (14) days of the request, by the original payment method where possible. This section does not limit Moretti Tutoring's right to suspend or terminate services for non-payment under Section 4.

6. No Guarantee of Results

All programs and sessions are provided on a good-faith instructional basis. Moretti Tutoring does not guarantee any specific score, grade, or admissions outcome, as results depend on many factors outside Moretti Tutoring's control, including student effort, attendance, and prior preparation.

7. Client Responsibilities

  • Provide accurate information about the student's academic history, needs, and any relevant accommodations.
  • Ensure the student attends scheduled sessions on time and completes assigned homework between sessions.
  • For online sessions, provide a reliable internet connection and a suitable device.

8. Intellectual Property

All worksheets, diagnostic tests, strategy guides, and other instructional materials created or provided by Moretti Tutoring remain the exclusive property of Moretti Tutoring. Clients and students may use these materials for personal, non-commercial study purposes only, and may not reproduce, distribute, sell, or otherwise share them with any third party without Moretti Tutoring's prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law, Moretti Tutoring's total liability arising out of or relating to the Services is limited to the amount paid by the Client for the specific session(s) or program giving rise to the claim. Moretti Tutoring is not liable for indirect, incidental, or consequential damages, including but not limited to admissions outcomes, scholarship decisions, or changes in grades or test scores.

10. Privacy

Information collected about the Client or student (including academic records, contact information, and payment details) is used solely to provide and administer the Services. It is never sold. It is shared only with the service providers that run the Site and the student portal on our behalf (principally Google, as described in our Privacy Policy), as required to process payment, or as required by law. The Privacy Policy explains in full what is collected and how it is used.

Business Transfers. If Moretti Tutoring is involved in a merger, acquisition, or sale of all or substantially all of its business assets, Client and student information may be transferred to the successor or acquiring entity as part of that transaction. The successor entity will remain bound by the terms of this Privacy section with respect to information collected before the transfer.

11. Changes to These Terms

Moretti Tutoring may update these Terms from time to time. Continued use of the Services after a change is posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles.
